our service
Please read the following terms of service below. By subscribing
to our service you agree to follow our rules regarding this
newsgroup service. We will cooperate with law enforcement
officials and with other system administrators in the legitimate
investigation of suspicious activity. Intentional violations
of the privacy of other users, whether on our system or at
another site, will be grounds for immediate termination of
your account and may lead to criminal prosecution or civil
penalties. We will not intentionally disclose the contents
of private files without the customer's permission or a court
order.

Copyright Act
You accept responsibility for determining the legal status
of any intellectual property you use or duplicate through
the Usenet servers. We cannot and do not review the information
passing through or stored on the Usenet server. You agree
not to violate copyright laws by transferring copyrighted
works through our service or by causing them to be transferred
or stored without the permission of the copyright holder.
Posting of copyrighted materials without the permission of
the copyright holder will result in suspension of posting
or termination of your account. We consider the exchange of
information about security mechanisms to be protected speech.
However, traffic in access codes, credit card numbers, or
similar information is a crime that we take seriously. We
expect you to respect the rights and privacy of all users
and to use your account only for lawful purposes.
We don't monitor what is available
online
We cannot be and are not responsible for the contents of any
of your communications through this service. Through our service,
you will have access to and you will at some time or another
become exposed to materials that you find offensive. Such
materials include sexually explicit text and (encoded) images,
pro-religious and anti-religious debate, questionable political
views, and hateful speech. All electronic communication services
such as ours are required to comply with the mandatory
reporting requirements of 42 U.S.C. § 13032(b),
which requires such services to report any apparent child
pornography to the National Center for Missing and Exploited
Children. In the event we are required to make a report, it
will include all information regarding the apparent child
pornography it believes may be of importance. We will strictly
comply with this reporting requirement.
We expressly disclaim liability for any harm resulting from
encountering such material on Usenet.
The use of your account
Only the owner of the account is allowed to use the respective
username/password. Sharing of accounts is not allowed and
will be cause for termination. The account owner accepts full
responsibility for all usage of the account. If an account
owner chooses to allow others to access their account, we
will still hold the account owner responsible for any instances
of inappropriate or abusive posting through that account.
We reserve the right to curtail what we deem as unreasonable
usage of our unlimited accounts in order to ensure the best
possible service for all customers. Our unlimited accounts
do not amount to a dedicated connection/newsfeed. If a customer
appears to be unable to maintain what we deem as a reasonable
use of the service, we may cancel, suspend, or decline to
renew service for that customer without notice. It is our
sole discretion to determine what encompasses unreasonable
use. Examples of disallowed uses of our service include (but
are not limited to) sharing accounts, using any type of news
caching/proxying server (Netwinsite Dnews/Surgenews, Netcache,
etc.), excessive downloading/uploading. You agree not to SPAM,
excessive cross-post, post copyrighted material, post promotional/advertising
(unless particular newsgroup accepts those types of posts),
use service for illegal purposes, "troll", harass,
etc. It is entirely up to our team of professionals to review
and determine if violations have been committed.
Billing practices
Subscription services are billed in advance. Each month's
charge will be generated on or near your monthly billing anniversary
date, and at any time your account is upgraded or renewed.
Payment is due upon receipt. Your account will automatically
be renewed at the end of each service period, repeating the
length of the previous service period, unless you specify
otherwise. Cancellation of subscription services can be done
by contacting customer support. All accounts are renewed automatically
until a cancellation request is received. Cancellations of
subscription services must be entered prior to the end of
the current service period in order for them to take effect
before the next service period begins. Cancellations submitted
after the next service period begins, will take effect when
that subsequent service period is completed. In most cases
refunds will not be given. No refunds will be considered for
accounts deleted for violation of our Terms of Service. Creation
of multiple subscriptions with our service will require payment
in full for each account created.
We're not responsible for your actions
You're responsible for all actions that occur in regards to
your account. As a condition of service, you agree to indemnify
and hold harmless Newsgroups-Download.com, its officers, employees,
agents, and shareholders, for any cause of action out of your
account with use or your use of the service.
In closing
We reserve the right to suspend, terminate, or refuse service
to anyone, at any time, for any reason. We reserve the right
to modify this 'terms of service' agreement without prior
notification. It is your responsibility to keep abreast of
our terms of service. You understand that Newsgroups-Download.com
is a reseller of usenet newsgroup access - this company does
not own or operate usenet servers. By subscribing to our service
and logging on to your account you agree to these Terms of
Service.
